1. Introduction

Welcome to Weasa Commerce. These Terms and Conditions govern your use of the Weasa Commerce platform (the "Service") operated by QF Innovate Private Limited ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Definitions

• "Service" refers to the Weasa Commerce platform, including the dashboard, APIs, and WhatsApp automation tools.
• "User" or "You" refers to any individual or entity that uses the Service.
• "Subscription" refers to any paid plan purchased through the Service.
• "Content" refers to all data, text, messages, and information processed through the Service.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Use of Service

By using Weasa Commerce, you agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
• Not use the Service to send spam, unsolicited messages, or content that violates WhatsApp's policies.
• Ensure that your use of WhatsApp Business API complies with Meta/WhatsApp's terms of service.
• Not attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Not use the Service to transmit malicious code, viruses, or harmful content.
• Maintain the security of your Shopify store credentials and API keys shared with the Service.

5. Subscriptions and Payments

Weasa Commerce offers subscription-based plans. By subscribing to a paid plan:

• You authorize us to charge you on a recurring basis through Razorpay payment gateway.
• Subscription fees are billed in advance on a monthly basis.
• Prices are in Indian Rupees (INR) unless otherwise stated.
• We reserve the right to modify pricing with 30 days' prior notice.
• Failed payments may result in suspension of service until payment is resolved.

6. Free Trial

We may offer a free trial period for new users. At the end of the trial period, your account will be automatically converted to a paid subscription unless you cancel before the trial ends. No charges will be made during the free trial period.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of QF Innovate Private Limited. The Service is protected by copyright, trademark, and other laws. You retain ownership of all content and data you provide through the Service.

8. Data Processing

By using the Service, you grant us permission to process your store data, customer information, and message content solely for the purpose of providing the Service. We will handle all data in accordance with our Privacy Policy and applicable data protection laws.

9. Limitation of Liability

To the fullest extent permitted by law, QF Innovate Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.

10. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or through the dashboard settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
